LEGAL
TERMS & CONDITIONS.
LAST UPDATED · OCTOBER 2026
1. Who We Are
These Terms & Conditions (“Terms”) govern your use of physicallyfitforever.com and the coaching services and digital training programs offered through it (together, the “Service”). The Service is owned and operated by Physically Fit Forever, a business owned by Bartley Weaver IV in Kentucky, United States.
By using the Service, submitting an application, or purchasing a program, you agree to these Terms. If you do not agree, do not use the Service.
2. What We Offer
The Service includes online fitness coaching (monthly, 16-week, and annual plans) and digital training programs such as Superset City. Coaching may include custom diet and training guidance, access to a private client group, program materials, and scheduled check-in calls. Digital programs are delivered as downloadable or online-accessible materials for your personal use.
Coaching is an application-based service. Submitting an application or completing checkout does not by itself guarantee acceptance into coaching; if we cannot accept you, you will receive a full refund of any payment made.
3. Eligibility & Authority
You must be at least 18 years old to purchase from the Service. If you are purchasing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4. Health & Fitness Disclaimer
The Service provides fitness and nutrition information for general purposes. It is not medical advice, and Physically Fit Forever is not a licensed physician, dietitian, or medical provider. Consult your physician before beginning any diet, training, or supplement program, particularly if you have a pre-existing condition. You participate in the Service at your own risk.
5. Acceptable Use
You must not misuse the Service. This means you must not:
- use the Service for any unlawful purpose;
- commit fraud, spam, or misrepresent who you are;
- infringe our intellectual property or that of others;
- interfere with the security of the Service, including introducing malware, probing or scanning for vulnerabilities, scraping, or attempting to gain unauthorized access; or
- share, resell, or redistribute program materials or access links.
6. Accounts & Credentials
Where the Service provides you with private access links or credentials (for example, a personal program link), you are responsible for keeping them confidential. You are responsible for all activity under your access. Do not share your personal access link — program content is licensed to you alone.
7. Intellectual Property
The Service, including all program materials, written content, designs, branding, the “Physically Fit Forever” name and logos, and related documentation, is owned by Physically Fit Forever and protected by intellectual property laws. We retain all right, title, and interest in the Service.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its materials for your personal, non-commercial use under the plan you purchased. You may not reverse engineer, copy, resell, redistribute, or publicly display the materials, or circumvent any technical limits on their use.
If you submit content to us (such as intake questionnaires, photos, or progress updates), you grant us a limited license to host and process that content solely to provide the Service to you.
8. Service Level
The Service is provided “as is.” We do not guarantee that the Service will be uninterrupted, timely, or error-free, and we disclaim all implied warranties to the fullest extent permitted by law, including warranties of merchantability and fitness for a particular purpose. We may make improvements and changes to the Service at any time.
9. Payment & Subscription Terms
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are handled by Paddle and are governed by Paddle’s Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. Please review them before purchasing.
Subscriptions
Monthly and annual coaching plans renew automatically for the same period until cancelled. You may cancel at any time from your plan-management page or by contacting us; cancellation takes effect at the end of the current paid period, and you keep access until then. We do not offer refunds for partial subscription periods beyond the refund period described in our Refund Policy.
10. Suspension & Termination
We may suspend or terminate your access to the Service, with or without notice, if you: materially breach these Terms; fail to make a required payment; create a security or fraud risk; or repeatedly or seriously violate our policies. If your access is terminated for breach, you will not receive a refund for the current period.
If your access ends (by cancellation or termination), your personal access links stop working. If you request it before termination, we will give you a reasonable window to export your personal program materials.
11. Limitation of Liability
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless Physically Fit Forever from claims arising out of content you submit, your unlawful use of the Service, or your violation of these Terms.
12. Assignment
You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business.
13. Force Majeure
We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, illness, power or internet outages, or governmental action.
14. Changes to These Terms
We may update these Terms from time to time. The current version is always posted on this page. Continued use of the Service after an update constitutes acceptance of the updated Terms.
15. Governing Law & Disputes
These Terms are governed by the laws of the United States and the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Kentucky, and you consent to their jurisdiction.
